Kahana Feld Secures Summary Judgment for Subcontractor in Seven-Figure Construction Defect Case 

Kahana Feld partner Laurence Granite, with the support of attorney Stefan Guerrero, secured summary judgment on behalf of his client, a subcontractor, in a seven-figure residential construction defect lawsuit in Maverick County, Texas. 

The Court dismissed, with prejudice, the general contractor’s third-party claims against the client, removing the subcontractor from the litigation. The homeowners had not asserted direct claims against the subcontractor, and the applicable limitations period for doing so had expired. 

The general contractor opposed Kahana Feld’s motion but failed to present sufficient evidence establishing causation or damages. The Court’s ruling provided the client with a complete dismissal from the case and eliminated its potential exposure to the claims at issue.
