Kahana Feld Secures Favorable Resolution in Complex Construction Defect Case

Kahana Feld partner John Donovan and attorney Brittney Madrigal secured a favorable resolution for their client in a complex construction defect matter in Bexar County, Texas. 

After Kahana Feld filed Traditional and No-Evidence Motions for Summary Judgment, the general contractor voluntarily nonsuited all claims against the firm’s client, including allegations of breach of contract, contribution, negligence, and breach of implied warranty. 

The matter involved multiple parties, retained experts, extensive discovery, and a broad range of alleged construction defects. The voluntary nonsuit brought the client’s involvement in the litigation to a successful conclusion and eliminated its exposure to the claims asserted by the general contractor.
