Kahana Feld Key Appellate Win: California Court of Appeals Affirms Trial Court Order  

Kahana Feld partner Sharon Oh-Kubisch secured a significant appellate victory for the client in the California Court of Appeals Second Appellate District, affirming the trial court’s order. Central to the Court of Appeal’s reasoning was Litke O’Farrell, LLC v. Tipton, an instrumental case demonstrating why a creditor could not enforce a judgment against the non‑debtor spouse, given the parties’ marital settlement agreement (MSA) designating the properties as her sole and separate property. The decision reinforces the principle that a properly executed MSA can shield a non-debtor spouse’s awarded assets from later creditor claims.  

The appellate briefs were the product of a collaborative team effort, with substantial contributions to strategy, research, and drafting by partners John (Jack) Watkins, Michelle Martin, and Sharon Oh-Kubisch. The coordinated approach ensured a focused presentation of the legal issues and a strong defense of the trial court’s ruling.
