On April 6, 2020, the Department of Labor (DOL) issued additional guidance in its “Questions and Answers” for employees and employers on the federal Families First Coronavirus Response Act (FFCRA.)

The updated “Questions and Answers” can be found here (they start at #60, with some minor revisions to earlier answers):

The additional guidance from the DOL regarding the FFCRA addresses, among other things, how employers should evaluate FFCRA leave eligibility due to shelter-in-place orders, the standards to be used in evaluating when schools and places of care are considered closed, and clarifying the definition of “individual” under the emergency paid sick leave portion of the FFCRA.

We will provide further updates as additional guidance is published in the coming days and weeks.
