Irvine, Calif., September 3, 2019  –  On behalf of its client MediGreens LLC, Kahana & Feld prevailed on its claims that Mark Talaat Nashed breached fiduciary duties, which were committed fraud, oppression and malice entitling MediGreens to recover $173,500 in compensatory damages and $80,000 in punitive damages.  MediGreens was awarded another $8,266.11 for costs.   The judgment followed an eight-day trial before Hon. Derek. W. Hunt of the Superior Court of the State of California, for the County of Orange.

The trial was bifurcated into two phases, each conducted as a separate trial.  Phase one determined liability, a result of which the Court ruled in favor of MediGreens on its claims. Kahana & Feld also obtained complete defense ruling against Nashed on all of his counterclaims.

The case was tried by Kahana & Feld LLP Partner, Avi M. Attal, Esq., who has handled numerous bench and jury trials for Kahana & Feld clients in litigation ranging from business and partnership disputes to employment matters.  Mimi Ahn, Esq., assisted Mr. Attal on the matter and at trial.  Ms. Ahn has also has a successful track record of handling trials and arbitrations for Kahana & Feld’s clients.
