Kahana Feld Secures Summary Judgment in Insurance Subrogation Dispute

Kahana Feld New York partner Rachael Marvin, along with Kennedys Law partner Gary Kull and associate attorney Alexandra DeBonte, successfully obtained summary judgment dismissal of plaintiff’s complaint in a high-stakes New Jersey subrogation action for construction defect claims arising from the loss of a warehouse. After paying out a multimillion-dollar claim, plaintiff brought a subrogation action against our client, a concrete subcontractor, and alleged their defective work caused and/or contributed to the structural collapse of the warehouse following a tornado event. 

The Court held that our client qualified as an additional insured under the Builder’s Risk policy and the express waiver of subrogation in the policy barred plaintiff’s claim. The Court also rejected plaintiff’s argument that alleged defective work forfeited our client’s protected status and emphasized the clear policy language in interpreting this coverage dispute.
