Kahana Feld secured a legal victory this week in a multimillion-dollar wrongful death case after the U.S. District Court for the District of Nevada granted a motion for summary judgment.
Partner Eran Forster and our team defended the client, a global healthcare company, in a difficult case alleging wrongful death, negligence, negligent security, negligent hiring, and loss of consortium claims as a result of an attack that occurred near the client’s property.
The plaintiff alleged the client was ultimately liable for damages; however, after careful review of Nevada premises liability law, our team drafted and argued a motion for summary judgment. The court concluded the client did not owe a duty of care to the plaintiffs, finding the assault was not reasonably foreseeable and there was insufficient evidence to establish that the client controlled the location where the incident occurred.
The court’s order fully resolved the case in our client’s favor and underscores the importance of having an experienced defense team with extensive premises liability experience.
